The following information provides a simple overview of what happens to your personal data when you visit our Facebook and/or Instagram pages. The Facebook and Instagram service is a product provided by Meta Platforms Ireland Limited.

Personal data includes all data with which you can be personally identified.

When you visit our Facebook and/or Instagram pages, which we use to promote our products and services, certain information about you is processed.

Facebook and Instagram share infrastructure, systems, and technology with other Meta Platforms companies (including WhatsApp and Oculus) to provide a certain uniformity across all products used by you from Meta Platforms companies. For these purposes, Facebook & Instagram also process information about you across Meta Platforms companies to the extent permitted by applicable law and in accordance with their terms of use and policies.

Facebook & Instagram share information globally, both internally among Meta Platforms companies and externally with their partners, as well as with those with whom the user connects worldwide and shares something. According to Meta Platforms, these data transfers are necessary to provide the services outlined in the Facebook terms and Instagram terms and to operate globally and provide the user with their products. Page Insights

Meta Platforms provides us with anonymized statistics and insights for our Facebook and/or Instagram pages, through which we gain insights into the types of actions people take on our page (so-called "Page Insights"). These Page Insights are created based on certain information about individuals who have visited our page.

This processing of personal data is carried out by Meta Platforms and us as joint controllers.

Name and address of the controllers

Joint controllers for the operation of this Facebook page or Instagram page are, within the meaning of the EU General Data Protection Regulation (EU GDPR) and other data protection regulations:

This agreement was provided in this form by Facebook Ireland Ltd. (now renamed to Meta Platforms Ireland Ltd.) and we, as operators of a Facebook Business page or Instagram page, accept it by using Facebook or Instagram. We cannot assess whether this agreement meets the requirements of Art. 26 GDPR.

Information about our Facebook page or Instagram page

We use these pages to promote our products and services and to interact with you as a visitor and user of this Facebook page or Instagram page (building and maintaining contact, acquisition).

Legal basis: The operation of this Facebook/Instagram page and the processing of users' personal data is based on our legitimate interests pursuant to Art. 6 para. 1 lit. f GDPR to draw attention to us and our services through modern marketing opportunities and to offer (potential) customers and other interested parties another means of contact. (Consent pursuant to Art. 6 para. 1 sentence 1 lit. b) GDPR for the processing of personal data can only be obtained technically by Facebook or Instagram. To our knowledge, Facebook and Instagram currently do not offer such an option.)

Processing of personal data by Facebook

The European Court of Justice (ECJ) ruled on June 5, 2018, that the operator of a Facebook page, together with Facebook, is responsible for the processing of personal data. After the rebranding of Facebook Ireland Limited to Meta Platforms Ireland Limited, this judgment applies to Meta Platforms. Since Instagram is operated by Meta Platforms, the judgment can be extended to Instagram as well.

We are aware that Meta Platforms processes user data for the following purposes:

  • Providing, personalizing, and improving their products
  • Providing measurements, analytics, and other business services
  • Providing personalized advertising
  • Promoting protection, integrity, and security
  • Communicating with users
  • Research and innovation for social purposes

Meta Platforms uses cookies to store and further process this information, which is stored on users' various devices. If the user has a Facebook or Instagram profile and is logged in, storage and analysis also take place across devices.

Meta Platforms shares information globally, both internally among Meta Platforms companies and externally with their partners, as well as with accounts with which the user connects worldwide and shares something. According to Meta Platforms, these data transfers are necessary to provide the services outlined in the Facebook terms of use and Instagram terms of use and to operate globally and provide the user with their products.

Meta Platforms uses standard contractual clauses approved by the European Commission (https://www.facebook.com/help/566994660333381) and, for data transfers from the EEA to the USA and other countries, relies on adequacy decisions issued by the European Commission regarding certain countries.

The European Commission has only partially classified the USA as a so-called safe third country since, from its perspective, the level of data protection prevailing there is not sufficiently high by default.

Statistical Data

For pages, Meta Platforms provides us as page operators with statistics and insights to help us gain insights into the types of actions people take on our pages ("Page Insights").

Page Insights are summarized statistics created based on certain events logged by Meta Platforms servers when individuals interact with pages and associated content. Meta Platforms provides us with these. We have no control over the creation and scope of this data processing and cannot issue it.

The following information is provided by Facebook or Instagram:

  • You view a page, post, video, story, or other content associated with my page
  • You react to a story
  • You subscribe to or unsubscribe from our page
  • You like or unlike a page
  • You recommend our page in a post or comment
  • You comment on a page post, share it, or react to it
  • You click on a button on our page (e.g., website button)
  • You view an event hosted by us, react to an event, or click on a link for an event ticket.
  • You initiate a messenger conversation with us.
  • You preview page content by hovering over a link to our page, the name, or the profile picture of our page.
  • You view items in our shop or click on them. Additionally, I see:
  • Location and time of your action
  • Country/city (estimated based on IP address or from the user profile for logged-in users)
  • Language code (from the HTTP header of the browser and/or language settings)
  • Age/gender group (from the user profile, only for logged-in users)
  • Previously visited website (from the HTTP header of the browser)
  • Whether the action was performed on a computer or a mobile device (from the browser user agent or app attributes)
  • Facebook or Instagram user ID (only for logged-in users) Data related to Facebook groups linked to our Facebook page is also provided in this way.

These insight capabilities can be adjusted and/or expanded at any time by Meta Platforms. We use this information to tailor our content to the interests of our users by using preferred formats more frequently, adjusting the timing of our post publications to match the usage times of our users, thereby increasing our reach, etc.

Your Rights

Under the DSGVO, user rights (so-called data subject rights) have been strengthened:

You have the right to obtain free information about the data stored about you by Meta, as well as the right to correction, restriction of processing, or deletion of this data if necessary. Please contact Facebook, Instagram (or Meta) directly for this purpose.

You also have the right to complain to the data protection supervisory authority about the processing of your personal data by Meta. We have agreed with Facebook that the Irish Data Protection Commission is the lead supervisory authority responsible for overseeing the processing for Page Insights. You always have the right to lodge a complaint with the Irish Data Protection Commission (see www.dataprotection.ie) or any other supervisory authority.

If questions about information are directed to us as page operators, we are obliged, in accordance with the additional agreement with Facebook (Meta), to forward these inquiries to Meta within 7 days, regardless of whether they are inquiries from private individuals or authorities (see Controller Addendum https://www.facebook.com/legal/terms/page_controller_addendum).

Lastly

If you no longer wish to have the data processing described here in the future, simply sever the connection of your user profile to our page by clicking the "I don't like this page anymore" button on Facebook or the "Unfollow" button on Instagram!
